But first, the Backstory: In the story of
dueling ordinances on Big Island, Bill 24 (boo!) won out over Bill 194;
however, then parts of Bill 194 (yay!) were added into Bill 24 making it a better, more protective
ordinance than it was.
Yay!
BUT one key ingredient is missing: Small cells!
In PCLUED meeting Feb. 4 the Planning Director incorrectly stated small cells couldn’t be regulated and cited HRS 206N, Subsection 4, as the reason.
But he skipped over a crucial part of that law, namely, HRS 206N, Subsection 1:
APPLICABILITY
HRS 206N only applies to mounting small cells on publicly owned poles. Most utility poles are owned by Hawaiian Electric Ind., a private company. Therefore HSR 206N doesn’t apply to them!
Small cells can and should be regulated. We are asking the PCLUED committee to amend the definition of
“Telecommunications antenna” to include small cells.

Please support the amendment to include small cells in Bill 24. The Director misspoke when he said small cells couldn't be regulated here. Wireless technology is constantly changing and the ordinance must keep
pace. Several years ago the County adopted a resolution to halt 5G small cells. They are a novel and an untested technology that has raised alarm bells around the world and caused dozens of local jurisdictions across the country to regulate deployments. Big Island needs an ordinance that includes small cells.
If you can attend the meeting online or in person, that's best! If not, please submit written testimony.
If you missed the Monday deadline, submit now. All testimony, regardless of when it's submitted, becomes part of the record.
